Triple E Technology Contract
The following terms and conditions are subject to change without notice:
General Statements
The terms “Triple E Technology” and “We” refers to the entity itself and the business owner(s), employee(s), and affiliate(s) providing service. The terms “Client”, “Customer”, and “You” refers to the individual(s) and/or business(es) receiving service. This agreement covers all possible services that may be obtained from Triple E Technology, including but not limited to computer repair, computer sales, system consulting, networking, surveillance systems, mobile device repair, and other related services. This contract does not expire on any certain date. Triple E Technology may update the labor rates, service call rates, and emergency service call rates at any time after this contract is executed by emailing or texting the customer informing them of the changes. The updated rates will supersede the rates found in this agreement.
Terms & Conditions
This contract is a binding agreement between Triple E Technology and the client. The client may be a single person, a business/organization, or both. This agreement only covers service (provided by Triple E Technology) from the date it is executed and moving forward. You must agree to these terms and conditions when you agree to have Triple E Technology provide service to you. This contract does not guarantee or retain services by Triple E Technology for a client, as Triple E Technology reserves the right to refuse to perform services at any time for any reason. This contract does not guarantee Triple E Technology certain jobs, projects, or work. The client may cancel scheduled service at any time. However, the client will be liable for any incurred parts/equipment expenses, service call expenses, and/or labor expenses that have been authorized. This agreement shall be governed by the laws of the Commonwealth of Pennsylvania.
Service Area
Triple E Technology is based in Perry County, Pennsylvania and serves Perry County with no service call fee. We serve Cumberland, Dauphin, and Juniata Counties with a $45 service call fee. We also serve Fulton, Franklin, Adams, York, Lancaster, Lebanon, Berks, Schuylkill, Northumberland, Snyder, Union, Mifflin, Centre, Huntingdon, and Blair Counties with a $130 service call fee. The service call fee for outside of the above counties is $1.34 per mile per round trip. All service call fees include vehicle travel expense, travel labor expense, tolls, and parking fees.
Estimates
Estimates can be requested by the client. However, estimates are not exact quotes and cannot always be used to accurately forecast the final cost of a project. Estimates are meant to give ballpark pricing for products and/or services. If more or less parts are used, more or less labor is used, or if other services are rendered, the invoice for the project may be higher or lower than the estimate. Estimates are produced free of charge. However, if a site survey or a project consultation is needed, the client will be billed for those services.
Labor & Payment
Service labor is billed at $64 per hour with a one-hour minimum charge per labor occurrence for on-site service. A one half-hour minimum charge is used for remote service or off-site labor. All work is completed on a time and material basis. In rare circumstances projects may be completed on a flat-rate basis (or with negotiated hourly rates) with the rates and scope of work being fully documented beforehand. Service labor is tracked electronically down to the minute and billed accordingly. All clients are required to pay for services rendered upon receipt except for authorized credit customers. Any invoice that is marked “Due on Receipt” is expected to be paid within 5 business days of the invoice date. If an invoice is not paid within the 5 days, the payment is considered late. A fee of 5% of the amount due or $15, whichever is greater, will be added on the 6th day and every month thereafter. Credit customers in good standing will be billed at the end of each month with a 30-day payment period unless otherwise noted. Credit accounts will incur a 5% or $15 (whichever is greater) finance charge/late fee per month after the 30-day payment period. If payments are made to any account with active finance charges/late fees the payment will pay all finance charges/late fees first and then be applied to the oldest invoices. We accept payment via cash, check (only local customers or customers with preauthorization to use payment by check), PayPal, online bank payment (ACH), and all major credit/debit cards. There will be a $50 charge on all returned checks. Please contact us if you have any questions regarding payment.
Emergency Service
Triple E Technology offers 24/7 emergency service. This service is primarily used by commercial customers, but it is also offered to residential customers. The emergency service fee is $100 plus any applicable service call fees. All labor, parts, and equipment billed during emergency service is billed at 150%. Triple E Technology will make every effort to reach the work location as quickly as possible but cannot guarantee a standard response time. Response time will be discussed when the emergency service call is ordered.
Privacy Policy
Any private information stored on your computer/device or viewed by Triple E Technology during a service period will be held in strict confidentiality unless disclosure is required by law. The information we see and receive will not be given, sold, or used for any purpose other than to provide service to or communicate with the customer. Triple E Technology reserves the right to disclose our client list (Name, location, and service category only). We will not sell, rent, or otherwise distribute your contact information to any third-party company of any kind. Triple E Technology may record phone calls and in person conversations with the customer or direct affiliates to the customer. We reserve the right to publicly respond to reviews and/or comments directed to or mentioning Triple E Technology. We reserve the right to publicly display project correspondence, project details, and other facts when responding to reviews and/or comments directed to or mentioning Triple E Technology. We do not condone SPAM or send any unsolicited email. We respect your privacy and use the utmost care to protect it.
Liability
Triple E Technology is hereby removed from all liability claims directly or indirectly caused by an owner, employee, affiliate, or equipment used or installed by Triple E Technology. This removal of liability applies to, but is not limited to:
- Fire
- Third-party theft
- Electrical malfunction or damage
- Loss of business
- Property damage
- Data loss
- Personal injury
- Death
The client and their affiliates are removed from liability regarding personal injury or death of Triple E Technology’s owner(s), employee(s), and affiliate(s), unless the client or affiliate’s negligence is the cause of personal injury or death.
Refunds, Returns, and Warranty
All claims and returned goods must be accompanied with your invoice. We do not offer cash refunds. Items are not returnable after 30 days. Items returned within 30 days are subject to a 20% restocking fee. Items may be non-returnable if they are open and/or used at the discretion of Triple E Technology. Special order parts are non-returnable. The warranty details below may be updated from time to time. When warranty information is updated on our website, it automatically supersedes the warranty details on this agreement.
All work performed by Triple E Technology is guaranteed to be free from workmanship errors for one (1) year immediately starting after that specific work was performed. This warranty is a limited warranty. See complete warranty details below:
- Triple E Technology will repair the workmanship error(s) and bear the cost of the labor and part(s)/item(s) when the issue is reported during the specified warranty period and Triple E Technology has reasonable access to the problem for service.
- Triple E Technology reserves to right to refund the original labor charge excluding part(s)/item(s), service call charges, and other project expenses in lieu of repairing the workmanship error(s).
- The warranty period starts immediately after the service labor was completed or billed to the customer, whichever comes first.
- This warranty does not cover failures due to acts of God, electrical surge, age, normal wear and tear, abuse, misuse, neglect, alteration, impact, or accident.
- This warranty does not cover service call charges, shipping fees to or from the customer, emergency service fees, or activation fees.
- The warranty will be voided if a surge protector is not used for devices that plug into and use standard 120-volt power outlets.
- The warranty coverage is limited to 100% of the original purchase price of the project including service labor and part(s)/item(s) sold by Triple E Technology with the warranty in question.
- When a customer supplies any part(s), item(s), equipment, or supplies for a project the entire project is non-warrantable.
- If Triple E Technology accepts a customer supplied part(s), item(s), equipment, or supply(ies) the customer will be liable for extra labor and service call charges if the item(s) is found to be incorrect or damaged in any way. Extra labor may be needed to test the item(s) and/or research compatibility and/or install/de-install the item for inspection and testing. The customer will also be liable for paying for replacement part(s), item(s), equipment, or supply(ies) if Triple E Technology is authorized to complete the job.
- This warranty does not cover personal injury/death, software problems, damage to software, loss of data, or loss of revenue/sales.
- This warranty is only valid for the original purchaser.
If a part(s)/item(s) sold by Triple E Technology includes a warranty, the warranty period and warrantor will be listed on the invoice. Most warranties are supplied by the vendor, manufacturer, or distributor, but some parts/items come with a direct limited warranty from Triple E Technology. If the warranty is from the vendor, manufacturer, or distributor, please refer to their specific warranty information for further details. - Triple E Technology will repair or replace the defective part(s)/item(s) and bear the cost of doing so when the issue is reported during the specified warranty period and Triple E Technology has reasonable access to the problem for service.
- Triple E Technology reserves to right to refund the original warrantied purchase price of the part(s)/item(s) excluding labor, service call charges, and other project expenses in lieu of repairing or replacing the part(s)/item(s).
- The warranty period starts immediately after the part(s)/item(s) was installed or sold to the customer, whichever comes first.
- This warranty does not cover any part(s)/item(s) that fails due to acts of God, electrical surge, age, normal wear and tear, abuse, misuse, neglect, alteration, impact, or accident.
- This warranty does not cover labor expenses for, including but not limited to, testing, diagnostics, de-installation, installation, setup, configuration, or personalization.
- This warranty does not cover service call charges, shipping fees to or from the customer, emergency service fees, or activation fees.
- The warranty will be voided if a surge protector is not used for devices that plug into and use standard 120-volt power outlets.
- The warranty coverage is limited to 100% of the original purchase price of the part(s)/item(s) sold by Triple E Technology with the warranty in question.
- This warranty does not cover personal injury/death, software problems, damage to software, loss of data, or loss of revenue/sales.
- This warranty is only valid for the original purchaser.
Statements
If any provision of this agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. In the event that invoices are referred to an attorney or agency for collection, the client agrees to pay all costs associated with collection, including, but not limited to, a reasonable attorney’s fee. If another active contract (only those provided by Triple E Technology) has been established before the executed date of this document, this contract supersedes, in full, the other agreement. If any other contracts exist between Triple E Technology and the customer and a discrepancy is found between the two agreements, this contract takes precedence over the other. Triple E Technology technicians are not certified or licensed lawyers, CPAs (certified public accountant), or electricians. If any advice is given in any of these areas of expertise, accuracy of information is not guaranteed. You should contact the correct professional for help. If Triple E Technology is servicing equipment off-site and has the equipment in their possession, the client has 30 days to pick up and pay for the diagnostics, repairs, and parts after Triple E Technology notifies the client that the equipment is ready to be picked up. If the client does not pick up and pay in full for the diagnostics, repairs, and parts, they forfeit their equipment (including data and accessories). Thereafter, Triple E Technology becomes the legal owner and can recycle, dispose, or otherwise get rid of the equipment. The original owner is still liable to pay the invoice for the diagnostics, repairs, and parts.
Signature & Delivery
This agreement may be executed electronically with signatures or electronically using the agreements form on our website at https://tripleetechnology.com/agreements. This agreement may also be executed by being signed on paper. All types of signatures make this document a legal binding agreement between Triple E Technology and the customer. If this document is completed electronically, the customer’s copy will be emailed to the customer within 24 hours. This agreement will be retained by Triple E Technology. A copy may be requested at any time. Copies of this document will be delivered via email or the postal service depending on client preference.
The person signing/executing this contract becomes a personal guarantor to this agreement. This person certifies they have the right and authorization to sign for themselves and for the business if also signing for a business. This person gives a personal guarantee that Triple E Technology will be paid on time for services rendered and accepts full responsibility for this agreement.
By executing this agreement, you:
- Agree to the terms outlined above
- Agree to have Triple E Technology perform work on your premise(s)
- Allow Triple E Technology to service your electronic equipment
